Florida Spammer Gets Sued [29th August 2003]

Baltimore,MD - Magikmyth Design & Technical Services filed in court on 8/29/03, for Spamming.

Mr Ernie Gutierrez of GMTools in Florida has a pending court date. Mr Gutierrez is in the habit of spamming, the product he is selling is CDs on government buyer, credit card holder, and email addresses. The price tag in the neighborhood of $400.00.

Mr. Gutierrez also like to place other addresses in the to line of the emails, so it look like the mailwas to go somewhere else.

Mr. Gutierrez was contact by Michael Simmons of Magikmyt Design & Technical Services several time. Mr. Gutierrez responded by thinking it was a joke, to the point of being rude, and make very rude and suggestive comments.

Now the joke is on Mr.Gutierrez, a claim in the amount of $2000.00 was file in the District Court of Maryland in Baltimore City on 8/29/2003.

NCO closed their file on GMTools so that the claim could be filed. At this point it looks lioke this might be the first case in Maryland for spamming.

Mr. Simmons also stated that while looking into GMTools, there is no information on the company in Florida, no corporate documents, not even a fictitious name filing. So the state of Florida may not know that he is operating a business. Mr. Simmons has stated that he will also seek criminal charges for fraud, since he is presenting himself as a company, when he is not registered.
